Triple Divorce: End of the 1000-year-old triple divorce in India, Supreme Court gave independence.

The Supreme Court on Tuesday struck down instant triple talaq terming it “unconstitutional". The constitution bench, headed by the Chief Justice JS Khehar, delivered a spilt verdict (3:2) invalidating the practice as part of the Muslim Personal Law. The majority judgment came from three judges — Justice Rohinton Nariman, Justice Kurien Joseph and Justice UU Lalit. CJI JS Khehar and Justice S Abdul Nazeer wrote the minority judgment.

Chief Justice of India JS Khehar and Justice Abdul Nazeer, the two judges in the minority, were of the opinion that triple talaq was "sinful" but valid. Justice Khehar said that triple talaq does not violate Articles 14 (equality), 19 (free speech) and 21 (life and liberty) of the Constitution.

But the two judges still called for triple talaq to be banned until the Indian government brought a law in this regard within six months.
